Please read these Terms of Use ("Terms") carefully before using the XPrivate application (the "App," "Service") operated by XPrivate ("us," "we," or "our").

1. Acceptance of Terms

By accessing or using the App, you agree to be bound by these Terms. These Terms apply to all visitors, users, and others who wish to access or use the App. If you disagree with any part of these Terms, you do not have permission to access or use the App.

2. Subscriptions

Certain features of the App are available through a subscription model ("Subscription(s)"). You will be charged in advance on a recurring basis ("Billing Cycle"). Billing Cycles are determined by the subscription plan you select—either monthly or annually.

If you choose to purchase a subscription, payment will be charged to your Apple ID account at the time of purchase confirmation. Your subscription will automatically renew unless canceled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase.

3. Free Trial

XPrivate may, at its sole discretion, offer a Subscription with a free trial for a limited period of time ("Free Trial").

We reserve the right to modify the terms of any Free Trial offer or terminate it at any time without prior notice.

4. Fee Changes

XPrivate, in its sole discretion and at any time, may modify the Subscription fees for the Subscriptions. Any Subscription fee change will become effective at the end of the then-current Billing Cycle.

XPrivate will provide you with a reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such change becomes effective.

5. Refunds

All purchases are final. We do not offer refunds for purchases made through your Apple ID.

6. Links to Other Websites

The App may contain links to third-party websites or services that are not owned or controlled by XPrivate.

We do not have control over, and are not responsible for, the content, privacy policies, or practices of any third-party websites or services. We do not endorse or assume responsibility for any third-party offerings or their websites.

You acknowledge and agree that XPrivate shall not be held responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by the use of or reliance on any such content, goods, or services available through third-party websites or services.

We strongly recommend reviewing the terms and privacy policies of any third-party websites you visit.

7. Limitation of Liability

To the fullest extent permitted by law, XPrivate and its directors, employees, partners, agents, suppliers, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages. This includes, but is not limited to, loss of profits, data, use, goodwill, or other intangible losses resulting from:

(i) Your access to or use of (or inability to access or use) the App;

(ii) Any conduct or content of any third party on the App;

(iii) Any content obtained from the App; or

(iv) Unauthorized access, use, or alteration of your transmissions or content.

This limitation applies regardless of the legal theory, whether based on warranty, contract, tort (including negligence), or otherwise, and even if we have been advised of the possibility of such damages.

8. Disclaimer

Your use of the App is at your sole risk. The App is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind—either express or implied—including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or performance.

We do not warrant that:

(i) The App will function uninterrupted, securely, or be available at any particular time or location;

(ii) Any defects or errors will be corrected;

(iii) The App is free of viruses or harmful components;

(iv) The results of using the App will meet your expectations.

9. Governing Law

These Terms are governed and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law principles.

Our failure to enforce any provision of these Terms shall not be considered a waiver of those rights. If any part of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

These Terms constitute the entire agreement between you and XPrivate regarding the App and supersede any prior agreements.

10. Changes

We reserve the right, at our sole discretion, to update or replace these Terms at any time. If a change is material, we will provide at least 15 days’ notice before the new terms take effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use the App after any changes become effective, you agree to be bound by the updated Terms. If you do not agree to the new Terms, you must stop using the App.
